Occupational Safety Act (ArbSchG)

Purpose of the act
The Act on the Implementation of Measures of Occupational Safety and Health to Encourage Improvements in the Safety and Health Protection of Workers at Work (Arbeitsschutzgesetz, ArbSchG) obliges employers to ensure the safety and health of their workers in all activities and to improve it continually (§ 3 ArbSchG).
Core employer duties
- § 5 Risk assessment: Identifying and assessing the hazards connected with the work for every workplace and activity.
- § 6 Documentation: The results of the risk assessment, the measures decided and the outcome of their review must be documented.
- § 10 First aid, firefighting, evacuation: Depending on the type and size of the business, the employer must put the necessary first-aid measures in place.
- § 12 Instruction: Workers must receive adequate and appropriate instruction on safety and health at work: when hired, when their duties change, and at regular intervals.
- § 13 Responsible persons: Duties may be delegated to reliable and competent people, but the employer remains responsible.
